Terms & Conditions

1. Agreement to These Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website at  www.athenaadvocacy.com and any information, forms, portals, or online features we make  available through it (collectively, the “Site”). By accessing or using the Site, you agree to these  Terms.
These Terms apply to your use of the Site only. They do not govern the services Athena Advocacy provides to clients (“Services”). Services are governed exclusively by a  separate written engagement agreement, applicable court orders, governing  instruments, and applicable law. If these Terms conflict with a signed engagement  agreement, the engagement agreement controls as to services.

2. Who We Are and What We Do

Athena Advocacy is a professional fiduciary firm. We serve in myriad roles including court appointed guardian and conservator, agent under power-of-attorney, healthcare agent,  trustee, consultant, or VA fiduciary. Our staff provides related administrative and  coordination services.

Service availability varies by jurisdiction.
Our fiduciary engagements are concentrated  in Vermont, New Hampshire, Massachusetts, and New York. We may accept clients in other  states for the Reservation of Services program, consultations, or other limited arrangements.  Enrollment in our programs, and communication with us, does not mean that  Athena is able, licensed, appointed, or willing to serve as fiduciary in your state  or county. Whether we can serve you depends on the laws, regulations, and requirements in  the state, court or agency involved, our capacity to do the work, and conflict of interest rules.  Ask us directly about availability in your state before engaging us for future service.

Athena is not a law firm. Athena is not a medical provider. Athena is not a  registered investment adviser, broker-dealer, bank, or trust company.
Our  authority in any matter is limited to the authority granted by the applicable court order,  governing instrument, agency appointment, or engagement agreement.

3. No Professional Relationship Is Created by Using the Site This is important.

• Using the Site, reading its content, submitting a contact or intake form, sending us an  email, or speaking with us in an initial consultation does not create a fiduciary  relationship, a client relationship, an agency relationship, an attorney-client  relationship, or any duty on our part to act on your behalf or on behalf of anyone else.

• No relationship is created until (a) we have accepted the engagement in writing and,  where applicable, (b) any required court appointment or agency appointment has been  issued.

• We may decline any prospective engagement for any lawful reason, including conflicts  of interest, capacity constraints, or geographic or service-scope limitations. We have  no obligation to accept an engagement, and no obligation to act until an  engagement is in effect.

• Do not rely on the Site, or on any communication with us before an engagement is in  effect, as a substitute for obtaining timely professional advice or intervention.

4. Not Legal, Medical, Tax, or Investment Advice

Content on the Site — including articles, guides, FAQs, checklists, and descriptions of legal  processes such as guardianship, conservatorship, powers of attorney, Medicaid, and VA  benefits — is provided for general informational purposes only. It is not legal, medical, tax,  financial, or investment advice, and it is not a substitute for advice from a licensed attorney,  clinician, or tax or financial professional.

Laws and program rules differ by state and county and change over time. Site content may  not be current or may not apply to your situation. Consult an appropriately licensed  professional before acting.

5. No Emergency or Urgent Services Through the Site The Site is not monitored continuously and is not a channel for urgent or emergency matters.

If a person is in immediate danger, experiencing a medical  emergency, or at risk of harm, call 911. To report suspected abuse, neglect, or exploitation of  a vulnerable adult, contact your state's adult protective services agency or law enforcement  directly. Do not use a website form to report an emergency.

6. Communications Sent via Site is Not Confidential or Privileged

Information you send through a website form, by unencrypted email, or by text message is is not guaranteed to be secure or confidential. Athena Advocacy is not a law firm: no attorney client privilege attaches to communications with us. Information you share through our  website form is subject to disclosure laws.

Do not send detailed health, financial, account, Social Security, or other  sensitive information through the Site or by unencrypted email.
Send only what is  necessary to describe the situation generally and allow us to contact you. We will establish a  secure channel before exchanging detailed information.

If you submit information about another person, you represent that you have the legal right  or authority to disclose it.

8. Intellectual Property

The Site and its content—including text, graphics, logos, forms, checklists, frameworks, and  the Athena Advocacy name and marks—are owned by Athena or its licensors and are  protected by copyright, trademark, and other laws. Except for the limited personal-use right  in Section 7, no license is granted. You may not use our name or marks without our prior  written permission.
If you send us unsolicited suggestions, ideas, or feedback, you grant us a non-exclusive,  royalty-free, perpetual license to use them without obligation or compensation. Do not send  us confidential information you expect us to keep confidential outside of an engagement.

9. Third-Party Links, Referrals, and Resources

The Site may link to or mention third parties, including courts, agencies, facilities, attorneys,  and service providers. Links and mentions are for convenience and information only and are  not endorsements, recommendations, or warranties. We do not control third parties and are  not responsible or liable for their content, services, acts, or omissions. Any dealings you have  with a third party are solely between you and that third party.

10. Testimonials, Case Examples, and Outcomes

Any testimonials, reviews, or case examples on the Site reflect the experience of specific  individuals in specific circumstances. Identifying details may be changed, combined, or  omitted to protect confidentiality. Past results do not predict or guarantee future  outcomes, and no outcome in any matter is guaranteed. Outcomes in fiduciary matters  depend on circumstances, judicial and administrative decisions, third-party actions, and  other factors outside our control.

11. Fees, Payments, and Subscriptions

Fees for services are set out in the applicable engagement agreement, fee schedule, or court approved compensation arrangement — not on the Site. Any rates or ranges shown on the  Site are estimates and are subject to change.

Online payments.
Payments made through the Site or a payment link we provide are  processed by a third-party payment processor subject to that processor's terms. You  represent that you are authorized to use the payment method you submit.

Recurring and subscription programs.
Enrollment in any Athena program with  recurring charges, including the Reservation of Services program, is completed through a  separate written agreement, not through the Site. The Site does not accept enrollments  and no enrollment, consent to recurring charges, or consent to automatic renewal can be  made through the Site. All program terms— governing price, billing frequency, initial term,  renewal, cancellation method and deadline, notice, and late-payment are set out in the  individual program agreement and enrollment materials you receive and sign separately.  Those documents control entirely.

12. Accessibility

We are working to make the Site accessible to people with disabilities. If you encounter a  barrier or need information in an alternative format, contact us at 802-765-2004 or  hello@athenaadvocacy.com and we will work with you to provide the information or  assistance you need.

13. Electronic Communications and Signatures

By providing an email address or phone number, you consent to receive communications from us electronically regarding your inquiry or engagement. You agree that electronic  records and signatures satisfy any legal requirement that a communication or agreement be  in writing.

14. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT  WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF  MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free  of harmful components, or that content is accurate, complete, or current.

Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the  above exclusions apply to the fullest extent permitted by law.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATHENA ADVOCACY, ATHENA  GROUP, LLC, AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND  CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,  CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS,  LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR  USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE  WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00) OR THE AMOUNT YOU  PAID US THROUGH THE SITE IN THE PRECEDING TWELVE MONTHS,  WHICHEVER IS GREATER.

This Section limits liability arising from use of the Site only. It does not limit,  waive, or modify any duty or liability arising from services Athena Advocacy provides under an engagement agreement, court appointment, or agency  appointment, and it does not limit liability for fraud, willful misconduct, or any  liability that cannot be limited under applicable law.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, these  limitations apply to the fullest extent permitted by law.

16. Indemnification

You agree to indemnify and hold harmless Athena and its owners, members, officers,  employees, and contractors from any claims, damages, losses, liabilities, and expenses  (including reasonable attorneys' fees) arising out of your use of the Site, your breach of these  Terms, or your submission of information about another person without the legal right or  authority to do so.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Vermont, without regard to its conflict of-laws rules.

Courts:
Any dispute arising out of or relating to these Terms or the Site will be brought  exclusively in the state or federal courts located in Vermont, and you consent to the personal  jurisdiction and venue of those courts.

This Section applies to disputes about the Site. Disputes about services are governed by the  dispute-resolution provisions of the applicable engagement agreement and by the jurisdiction  of any court supervising the matter, including any probate or surrogate's court, whose  jurisdiction is not affected by these Terms.

18. General

• Changes. We may revise these Terms at any time. Revisions are effective when posted  with an updated "Last Updated" date. Your continued use of the Site constitutes  acceptance. Review these Terms periodically.
• Severability. If any provision of these terms is held unenforceable, the remaining  provisions remain in effect, and the unenforceable provision will be modified to the  minimum extent necessary to make it enforceable.
